LEGAL

Terms of Service

Effective September 4, 2026HaulWorth · Illinois, United States

These Terms govern your purchase of and access to HaulWorth Basic, Road, Basic + Road, Owner Operator, Office Pro, and related services.

1. Agreement and operator

HaulWorth is operated by Ilija Tupacev doing business as HaulWorth in Illinois. By purchasing, activating, accessing, or using HaulWorth, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter a contract. You are responsible for accurate account information, protecting your password and activation codes, and activity under your account. Do not share access beyond the number of drivers or trucks included in your plan.

3. Plans and access

Basic and Road are one-time-purchase products, and Basic + Road combines both products. Owner Operator and Office Pro are monthly subscriptions. Current features, prices, and plan limits are shown on the Plans & Demos page at the time of purchase. We may improve, replace, or discontinue features while preserving paid access to the purchased product where reasonably possible.

4. Payments, renewals, and cancellation

Payments are processed by Square or another checkout provider displayed at purchase. Monthly subscriptions renew automatically until canceled. You may cancel a subscription at any time; cancellation stops future renewals and access continues through the end of the current paid billing period. Except where law requires otherwise, purchases and subscription charges are final and non-refundable. The full policy is available on the Cancellation & Refund Policy page.

5. Permitted use

You may use HaulWorth for lawful trucking, recordkeeping, routing, settlement review, and fleet-management purposes. You may not resell access, bypass plan limits, reverse engineer or interfere with the service, submit unlawful or misleading content, scrape service data, introduce malicious code, impersonate another person, or use HaulWorth to violate a law or another person’s rights.

6. Trucking and financial disclaimer

HaulWorth is an organizational and informational tool. It is not a motor carrier, freight broker, dispatcher, navigation authority, ELD provider, tax preparer, accountant, or law firm. Calculations—including settlement, profit, mileage, compliance, and IFTA-related results—are estimates based on information supplied by users or third parties. You must verify routes, clearances, restrictions, hours-of-service requirements, tax filings, settlement amounts, permits, compliance deadlines, and safe operating conditions using authoritative sources. Never interact with the service while driving.

7. Road information and user submissions

Fuel prices, weigh-station status, police, crash, hazard, closure, construction, parking, reviews, and other Road information may be incomplete, delayed, or inaccurate. User reports are not emergency alerts or official instructions. By submitting a report, review, comment, location, or other content, you confirm that you may share it and grant HaulWorth a worldwide, non-exclusive, royalty-free license to host, reproduce, format, display, and distribute it to operate and improve the service. We may remove content that is unsafe, unlawful, misleading, or abusive.

8. Your records

You retain ownership of information and documents you upload. You are responsible for obtaining any required permission before entering driver, customer, load, invoice, receipt, or compliance information. Keep independent copies of important business, tax, and compliance records; HaulWorth is not your sole record-retention system.

9. Third-party services

HaulWorth may use or link to third-party services such as Square, Mapbox, mapping providers, directions, phone services, and external websites. Their terms and privacy practices apply to their services. HaulWorth does not control and is not responsible for third-party availability, content, routing, transactions, or conduct.

10. Intellectual property

HaulWorth, its software, branding, interfaces, and original content are owned by HaulWorth or its licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the service for its intended purpose; they do not transfer ownership.

11. Suspension and termination

We may suspend or terminate access for nonpayment, misuse, security risk, unlawful activity, or a material breach of these Terms. You may stop using one-time-purchase products or cancel a subscription at any time. Sections that logically survive termination—including ownership, disclaimers, liability limitations, and dispute terms—remain effective.

12. Disclaimer of warranties

To the fullest extent permitted by law, HaulWorth is provided “as is” and “as available,” without warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, or non-infringement. We do not guarantee uninterrupted operation, error-free calculations, specific financial results, or that third-party or community information is current.

13. Limitation of liability

To the fullest extent permitted by law, HaulWorth and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, or business opportunities; vehicle damage; citations; tax or compliance consequences; or losses caused by reliance on routes, reports, calculations, or third-party services. Our total liability for a claim will not exceed the amount you paid HaulWorth during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so they apply only to the extent allowed.

14. Indemnification

To the extent permitted by law, you agree to defend and indemnify HaulWorth and its operator against third-party claims, damages, and reasonable costs arising from your unlawful use, your content, your violation of these Terms, or your infringement of another person’s rights.

15. Governing law and disputes

Illinois law governs these Terms, without regard to conflict-of-law rules. Before filing a claim, contact us and allow 30 days to try to resolve it informally. Unless applicable law requires otherwise, proceedings must be brought in a state or federal court with jurisdiction in DuPage County, Illinois. Either party may bring an eligible matter in small-claims court.

16. Changes and contact

We may update these Terms by posting a revised effective date. Material changes apply prospectively, and continued use after they take effect means you accept them. Questions may be sent to support@haulworthapp.com.
